The Office of the Ombudsman has ordered the one-month and one-day suspension without pay of Department Head II Raymundo Clavano of Iligan City General Services Unit for failing to disclose a real property in his 1999-2004, 2006, and 2009-2012 Statements of Assets, Liabilities and Net Worth (SALNs).

In case the penalty of suspension can no longer be implemented due to separation from service, the penalty is convertible to a fine equivalent to respondent’s one month and one day salary.

During the investigation, a lifestyle check was conducted on the respondent which revealed that he failed to disclose a real property in Del Carmen, Iligan City that he acquired on 11 November 1994 for P16,200.00.

In his counter-affidavit, Clavano explained that the sale did not materialize as he did not sign the deed of sale of the property bought from the Greenrock Estate Developer’s Corporation.

However, the Ombudsman noted that, “the respondent’s explanation on his failure to declare the property in his SALNs is bereft of any evidence.”

“Simply put, respondent failed to accurately accomplish his SALN, the filing of which is mandated by law. This failure to accurately accomplish his SALN makes him liable for simple neglect of duty,” the Ombudsman added.

Simple Neglect of Duty is defined as “the failure to give proper attention to a task expected of an employee resulting from either carelessness or indifference.”

Section 8 of R.A. No. 6713 requires every public official and employee “to accomplish and submit declarations under oath of, and the public has the right to know, their assets, liabilities and net worth and financial and business interests including those of their spouses and of unmarried children under eighteen (18) years of age living in their households” in the form of SALN to be submitted on or before April 30 of every year. ###
