The Office of the Ombudsman has found probable cause to charge Deputy Regional Director Akmad Mamalinta of the Police Regional Office in Davao City for Falsification of public document in connection with untruthful entries in his Personal Data Sheet (PDS).

Aside from criminal indictment, Mamalinta was also found administratively liable for Serious Dishonesty and was ordered dismissed from the service.  He was meted the accessory penalties of perpetual disqualification from public office, cancellation of eligibility and forfeiture of retirement benefits.  The penalty is convertible to a fine equivalent to respondent’s one year salary, in case of separation from the service.

Investigation found that in 2000, Mamalinta falsely declared in his PDS that he is a Career Executive Service Officer and that he completed his masteral degree at the Philippine Christian University (PCU).

The Fact-Finding Investigation Bureau, however, presented certificates from the Civil Service Commission and from PCU, proving that Mamalinta’s claims are absolutely false.

According to Ombudsman Conchita Carpio Morales, “in accomplishing and filing a PDS for purposes of promotion, all applicants have the legal obligation to disclose the truth of the data required especially their qualifications.”

“(Mamalinta’s) act of concealing the truth and deliberately asserting falsehoods in more than one entry in his PDS clearly exhibits his moral depravity, lack of integrity and predisposition to conceal the truth not only from his office but from the public, in general,” added Ombudsman Morales.###
