The Office of the Ombudsman has filed charges against former Norzagaray, Bulacan mayor Feliciano Legaspi, including Municipal Treasurer Cristeta Esteban and Municipal Accountant Manuel Marcial in connection with the delayed remittance of Government Service Insurance System (GSIS) premium contributions for the month of November 2009.

In an 11-page Resolution, the Ombudsman has found probable cause to indict the respondents for violation of Section 52 of the Government Service Insurance System Act (Republic Act No. 8291).  Investigation found that the municipality was able to remit the November 2009 premiums only in February 2010 even if the deadline for remittance was in January 2010.

The Resolution pointed out that under R.A. No. 8291, government employers are required to remit directly to the GSIS the employee’s and employer’s contributions within 30 days from the day the obligation fell due and demandable. Otherwise, the employer would be liable for delay, refusal or failure to remit under R.A. No. 8291. ###
